What is a settlement agreement and what can go wrong?
In case of a conflict, the parties can choose to take their case to court. However, this is not always the best way to resolve a dispute. Going through the courts usually takes a lot of time and money, and rarely results in a win-win situation.
A good alternative is to try to resolve the dispute together, if necessary with the help of lawyers or a mediator. If this succeeds, it is wise to record the agreed solution in a document. This document is usually called a “settlement agreement” or “termination agreement.”
If you are being dismissed (or you are dismissing someone) by mutual consent, clear and solid agreements must be made. These agreements are also recorded in a settlement agreement.
Be careful with this!
